1. Who we are

These terms are a binding agreement between you and Pitch Room L.L.C-FZ ("Pitch Room", "we", "us"), a company registered in Meydan Free Zone, Dubai, United Arab Emirates, licence number 2655954.01, with its registered address at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E. Pitch Room is our product and trade name.

2. Accepting these terms

By creating an account, ticking the box to accept these terms, paying for a plan or using Pitch Room in any way, you agree to these terms, our privacy policy and our cancellation and refund policy. If you don't agree, don't use Pitch Room.

Pitch Room is a professional tool for real estate agents, agencies and developers. You confirm that you use it for business, not as a consumer, and that you are at least 18 years old. If you accept these terms for a company or agency, you confirm you have the authority to bind it, and "you" includes that company or agency.

3. What Pitch Room is

Pitch Room is software, delivered online as a subscription, for presenting property to clients. The laptop shows the client's screen and the phone works as a private remote. Nothing physical is delivered.

Pitch Room is a presentation tool only. We are not a real estate broker, agent, developer, adviser or party to any transaction. We do not give investment, financial, legal, tax or valuation advice, and nothing shown in Pitch Room is an offer, a valuation or a recommendation to buy, sell or rent any property.

4. Automatic reading and information from the web

Pitch Room can read brochures, sales offers and other files you upload, and can look up public information on the web (for example developer track records, starting prices, prices per square foot, nearby launches, maps and drive times). This is done automatically, partly by artificial intelligence, and it can be incomplete, out of date or wrong.

• You must check every price, payment plan, size, date, comparison, availability and fact before you show it to a client.
• Comparisons and market figures are estimates for discussion only. They are not valuations and must not be presented as guaranteed.
• We are not responsible for any decision you or your clients make based on information shown in Pitch Room, whether it came from your files, from the web or from automatic reading.

5. Your account

• Give us accurate details and keep them up to date.
• One login is for one person. Don't share it, sell it or let anyone else use it. If a login is used by more than one person, we can block the account and charge a fine equal to the full price of one login, for the period you paid for, for each extra person who used it. Agency seats and developer licences cover only the seats paid for or agreed in writing.
• Keep your password private. You are responsible for everything done through your account, whether or not you authorised it.
• Tell us straight away if you think someone else has used your account.
• We may suspend or close an account that is shared, misused or used against these terms.

6. Plans, prices and payment

• Prices are in UAE dirhams (AED) and shown on our website. VAT and any other taxes are added where they apply.
• Agent plans are paid in advance, by card or Apple Pay, through our payment processor. We don't see or store your full card number.
• Plans renew automatically at the end of each period (month, 6 months or year) and are charged until you cancel.
• Nothing is charged during the 7-day free trial. If you don't cancel before it ends, the first payment is taken when it ends. One free trial per person or business.
• If a payment fails, we may pause or close your account until it's paid.
• We may change our prices. A new price applies from your next renewal after we tell you. If you don't agree, cancel before then.
• Agency and developer licences run for 6 or 12 months, under a written agreement: 50% when you sign and a post-dated cheque for the rest. Where that agreement says something different from these terms, the agreement applies.

7. Cancelling and refunds

You can cancel at any time; you keep access until the end of the period you paid for. Payments already made are not refunded except as set out in our cancellation and refund policy or where the law requires it.

8. Your content

"Your content" means everything you or your team upload or enter: brochures, sales offers, photos, floor plans, videos, prices, prepared answers, notes and client details. You keep ownership of it.

You confirm that you have every right and permission needed to upload and show your content, including the developer's permission to use their brochures, renders, photos and logos, and that showing it doesn't break any law or anyone's rights.

You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, analyse, adapt (for example, cut photos out of a brochure or make slides from it) and display your content to provide, secure and improve Pitch Room, and to create anonymised data as explained in section 10. This licence lasts while your content is on Pitch Room, and for anonymised data, without limit.

You are solely responsible for your content and for what you show and send to clients. We don't check your content, but we may remove or block any of it, without notice, if we believe it is unlawful, infringing, misleading or against these terms.

9. Information about your clients

If you enter information about your clients (for example names, phone numbers, notes or follow-ups in My clients), you decide what is entered and why. For that information you are the controller and we process it on your behalf, to provide Pitch Room.

• You confirm that you have a lawful basis and, where required, your clients' consent to enter their information and to send them presentations.
• You are responsible for telling your clients how you use their information, as the law requires.
• We will not sell your clients' personal information, or share it with anyone except as described in our privacy policy.

10. Anonymised and combined data

We may combine and anonymise information from the use of Pitch Room, so that it no longer identifies you, your clients, your agency or any other person. Examples: prices per square foot shown by area, which unit types and areas are presented most, how long each topic is shown, payment plans and launch prices.

Anonymised data belongs to us. We may use it, publish it, share it and sell it, for example in market reports and statistics, during and after your use of Pitch Room. It never includes names, phone numbers, email addresses or anything else that identifies a person.

11. Messages to your clients

When you send a presentation, Pitch Room opens your own WhatsApp (or another app you choose) with a message ready. The message is sent by you, from your own account. You are responsible for whom you message, what is sent and for following WhatsApp's rules and the law on marketing messages. Links you send can be opened by anyone who has them.

12. Fair use

You must not, and must not let anyone else:

• share, resell, rent, sublicense or give access to Pitch Room to anyone outside your plan;
• copy, modify, translate, decompile, reverse-engineer or try to find the source code of Pitch Room;
• copy its design, screens, features or way of working, or use Pitch Room or anything learned from it to build or help build a competing product;
• scrape, crawl, frame or extract data from Pitch Room by automated means;
• test, probe or break its security, overload it, or upload viruses or harmful code;
• upload anything unlawful, misleading, defamatory or infringing, or present property in a way that breaks the rules of the Dubai Land Department, RERA or any other authority;
• use Pitch Room to send spam or unsolicited messages;
• remove or hide any Pitch Room name, logo or notice, except where your plan lets you show your own logo.

13. Our property

Pitch Room, including its software, code, design, screens, animations, templates, texts, logos, the name "Pitch Room" and everything we create, belongs to us or our licensors and is protected by copyright, trade mark and other laws. These terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use Pitch Room during your plan. They give you no other right. Any rights not expressly given to you are kept by us.

14. Feedback

If you send us ideas, suggestions or feedback, we may use them freely, for any purpose, without paying you or owing you anything.

15. Other services

Pitch Room works with services run by others, for example WhatsApp, maps and map data (including OpenStreetMap), web search, artificial intelligence providers, hosting and payment processing. We don't control them and are not responsible for them, for their availability or for what they do with information you share through them.

16. Availability and changes

We work to keep Pitch Room running, but we don't promise it will always be available, fast, secure or free of errors. We may carry out maintenance, and we may add, change or remove features at any time. If we remove a main feature of your paid plan, we'll tell you and you can cancel.

17. No guarantee

To the fullest extent the law allows, Pitch Room is provided "as is" and "as available", without any guarantee or promise, express or implied, including about results, sales, commission, accuracy, quality, fitness for a purpose or non-infringement. We don't guarantee that using Pitch Room will win any client, sale or deal.

18. Our liability

• We are not liable for any indirect, incidental, special or consequential loss, or for lost sales, commission, deals, clients, profits, revenue, goodwill, reputation or data, however it is caused.
• We are not liable for any loss caused by information shown in Pitch Room (see section 4), by your content, by what you send to clients, or by any property transaction.
• Our total liability to you for everything connected with Pitch Room, of any kind, is limited to the amount you paid us in the 3 months before the event that caused the claim.
• Nothing in these terms limits any liability that the law doesn't allow us to limit.

19. Your responsibility to us

You will defend us, and pay for any loss, damage, fine, cost and reasonable legal fees we, our directors, staff and partners suffer, from any claim or demand made by anyone (including your clients, developers, agencies and authorities) that comes from your content, your clients' information, the messages you send, your property dealings, or your breach of these terms or of the law.

20. Suspending or ending your account

You can end this agreement at any time by cancelling. We can suspend, limit or close your account at any time if you break these terms, don't pay, put Pitch Room, us or others at risk, or if the law requires it. Where we reasonably can, we'll tell you first.

When your account closes, your right to use Pitch Room ends. We delete your content within 90 days, except what the law requires us to keep, backups that are deleted on their normal cycle, and anonymised data. Sections 4, 8 to 10 and 12 to 25 continue to apply after your account closes.

21. Events outside our control

We are not responsible for any delay or failure caused by events outside our reasonable control, for example internet, hosting or power failures, attacks, actions of governments or third-party services, war, epidemics or natural events.

22. Changes to these terms

We may update these terms from time to time. We'll show the new date at the top and, for important changes, tell you by email or in the app. If you keep using Pitch Room after a change applies, you accept the new terms. If you don't agree, cancel before then.

23. Law and disputes

These terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Dubai. Any dispute will be dealt with by the courts of Dubai, unless the law of the free zone where we are licensed requires otherwise. Before starting any claim, contact us first so we can try to solve it, and give us 30 days to do so.

24. General

• These terms, with our privacy policy, our cancellation and refund policy and any written agreement for your plan, are the whole agreement between you and us about Pitch Room.
• If any part of these terms is found invalid, the rest still applies.
• If we don't enforce a right straight away, we can still enforce it later.
• You may not transfer your account or these terms to anyone else. We may transfer them, for example if we sell or reorganise our business.
• We may send notices to the email address on your account.
• These terms are written in English. If they are translated, the English version applies.
